User Agreement

This user agreement is implemented by the management of the MOYO network, namely the Limited Liability Company "NRP" (01030, Kyiv, 44 Bohdana Khmelnytskoho Street, EDRPOU code 36469918) (hereinafter referred to as the "company") in order to regulate the relationships that arise in the course of the company's statutory activities, including with users of electronic commerce tools used by the company in its activities.

This agreement applies to the electronic commerce tools of the company, in particular the Moyo.ua website and the MOYO mobile application (hereinafter referred to as the "website," "mobile application," "company resources," respectively), etc.

Any person visiting the website or using it in any other way, including the mobile application, regardless of whose interests they act on, is automatically recognized as a user within the context of the terms of this agreement.

General Terms

By using the website or mobile application from any device, the user hereby confirms that they have read and agree to the terms of this agreement.

In case of disagreement with the provisions of this agreement, the user must leave the website or stop using the mobile application.

The company reserves the right to modify this agreement in whole or in part at any time without prior notice or consent. The new version of the agreement becomes effective upon its publication on the website or in the mobile application. Changes may be communicated to users in any manner not prohibited by law.

Use of company resources

The company provides all users with access to the materials of the website or mobile application. The content of the website and mobile application is protected by law in accordance with applicable materials, information, and their use. The company is not responsible for the content of external resources or links posted on the website or in the mobile application. The user has the right to download materials from the website/mobile application for personal, non-commercial use.

Any public (including non-commercial) use of materials, including (but not limited to) the distribution of website materials, trading in them, or making changes and adaptations to the materials, is prohibited without the written consent of the company.

Registration

By registering on the website and/or in the mobile application, the user confirms that they provide accurate personal data about themselves and consent to their collection, use, and processing. The company disclaims any responsibility for any consequences arising from the provision of false information by the user.

The company undertakes to comply with the legislation of Ukraine on the protection of personal data.

To delete a user's personal account, follow these steps:

• In the mobile application, go to the user's Profile in the "account management" section, press the "delete account" menu at the bottom of the page, and confirm the action.
• On the website, go to the user's Profile in the "personal data" section and select the "delete account" option, then confirm the chosen action.

Posting User Reviews, Materials, Comments

By posting materials and/or reviews on the website or mobile application, the user is responsible for the content of such materials, compliance with copyright, intellectual property rights, and their conformity to legislation, moral, and ethical norms of society.

The company reserves the right to moderate user materials/reviews. Accordingly, the company may refuse the user's request for the publication of materials in whole or in part. Decisions regarding publication are made solely by the company, at its discretion, without additional notice. Materials already posted by the user may be deleted at the company's discretion without prior warning or consent.

Disclaimer

By providing information about services and products, the company is not responsible if the content of the services and configurations of the products presented on the website/in the mobile application have been changed by the manufacturer. The company is not responsible for the accuracy of the specified characteristics and any possible errors of different nature. The images of products on the website or in the mobile application may differ from their actual appearance. The company reserves the right to make changes to the materials on the website (services, products, prices), update, and delete them at its discretion.

The company is not responsible and has no obligations to users in connection with any technical interruptions, website or mobile application malfunctions, and does not compensate for any damages or expenses incurred due to these circumstances.

The company is not responsible and has no obligations to users in connection with any theoretical or actual losses or damages associated with any content on the website/mobile application.

The products presented on the website or in the mobile application may not be available for purchase at all offline stores of the company's network. The price of the products in offline stores of the company may differ from the price indicated on the website and/or in the mobile application.

The prices indicated on the company's resources and information about product availability may change. The order amount may vary depending on the price, quantity, and assortment of the product available in the company at the time of shipment. The final price of the product is indicated in the settlement and/or accompanying documents provided to the buyer (or their representative) upon receipt of the order. In case of product unavailability, the company may unilaterally cancel the order.

Mailing and Informational Messages

By providing their email address and/or phone number, the user automatically agrees to receive newsletters from the company, as described in this section.

These newsletters contain information about upcoming sales promotions, giveaways, discounts, special offers, and other events for customers.

At any time, the user can unsubscribe from receiving newsletters by using the corresponding functionality in the body of the email (by clicking the "Unsubscribe" link at the bottom of the email). It is also possible to opt-out of newsletters by contacting the company via the hotline phone number provided on the moyo.ua website.

Computer Security

When visiting the company's website or using the mobile application, the company collects, stores, and processes information such as IP address, date and time of visit, browser type and language, as well as cookies files - solely for the purpose of optimizing the company's resources and protecting the integrity of its information space.

Cookies

Like many other companies, the company uses cookies technology on its website, in the mobile application, and beyond. Cookies are pieces of information that the website/mobile application transfers to the user's hard drive to store information related to the respective online resource. This technology enhances the capabilities of using the Internet, preserving its priorities when browsing a particular website. Cookies technology does not contain personal information and cannot configure the user's system or read information from the hard drive.

During the browsing of the website or the use of the mobile application, the company may place cookies on the user's device. These temporary cookies are used to calculate the number of visits to the company's resources. They are deleted when the user exits the browser. Persistent cookies may be stored on the user's device by the browser or mobile application. When registering, this type of cookie informs whether the user has visited the company's resources for the first time or has previously visited. Cookies do not contain personal data and can be blocked by the user at any time. Cookies do not receive personal information about the user and do not provide the company with contact information, nor do they receive any information from the user's device. The company uses cookies to determine the characteristics of its resources and offers that are most liked by users in order to provide more information in which they are interested. In addition, cookies are used to make the company's resources secure, protected, and convenient. Cookies provide support for security features. Cookies also help to assess the number and frequency of requests, as well as detect and block users or devices attempting to perform bulk information downloads from the company's resources.

The company uses all necessary cookies to ensure that users are provided with the most complete information about the company and its capabilities, so that the user can get the best result on its resources. If the user continues to use the website or mobile application, it means that the user agrees to the use of cookies by the company and to receive all cookie files, including the ability to send the user the latest information about the most relevant offers and promotions. The user can easily unsubscribe from newsletters or disable the use of cookies by changing the relevant settings on their device. The "help" button on the toolbar of most browsers contains information on how to block new cookies, receive notifications from the browser about receiving new cookies, or disable cookies.

The technical equipment of the company's resources may include modules:

Facebook, Twitter, Youtube (youtube.com), Google+ (plus.google.com), Telegram, Instagram, Viber.
These modules can be synchronization buttons for the user's account on the company's resources. If a visitor opens a web page equipped with such a plugin, their web browser will directly connect to the servers of Facebook, Twitter, LinkedIn, Google+, YouTube, Telegram, Instagram, Viber. The plugin will transmit data to the server about which sections of the company's resources the user has viewed. When using any functions of the plugin, this information will also be synchronized with the user's account on Facebook, Twitter, Google+, YouTube, Telegram, Instagram, Viber. Third-party service providers

During its operations, the company engages with other companies and individuals who perform various functions. For example, order fulfillment and delivery, customer support, administration of promotional campaigns, data analysis, etc. These entities may have access to personal information if necessary for performing their functions, but they are prohibited from using personal information for purposes other than those specified in this User Agreement and in the data processing and protection policy. The company requires them to maintain confidentiality.

Marketing activities

From time to time, the company may post messages about marketing (advertising) activities with the option to register online. In such cases, the company uses the information provided by the user to conduct the corresponding event. After a certain period of time following the end of the promotional campaign, personal information may be deleted from the company's database if the user has not given consent for its storage and use to receive further information from the company.

By participating in the promotion, the user hereby gives explicit consent to the free use of their name, surname, photograph, interview, or other materials about the user for advertising purposes, including the right to publish the name and photograph of such user in mass media, any printed, audio, and video materials, interviews with the media. This use is not compensated (not paid).
The conditions for the transfer of personal data to third parties in such cases are determined in the Regulation.

Final provisions

When a user places an order, participates in a promotion, survey, or otherwise interacts with the company, the user thereby gives their consent to this User Agreement and the provisions on the processing of personal data.

This Agreement is governed by the laws of Ukraine. Any disputes regarding the implementation of this Agreement will be resolved by the court of the respective jurisdiction, in accordance with the current legislation of Ukraine.
